Hire Terms & Conditions

These Hire Terms & Conditions apply to all Equipment supplied on hire by Traffic Site Equipment Limited (trading as TSE Supply), including the InflatorShield™ inflatable incursion deterrent.

(“the Company”)

1. Definitions

1.1
“Company” means Traffic Site Equipment Limited (trading as TSE Supply).
1.2
“Hirer” means the person, company or organisation hiring the Equipment.
1.3
“Equipment” means all items supplied on hire by the Company, including the InflatorShield™ inflatable incursion deterrent.
1.4
“Hire Period” means the period from delivery of the Equipment until it is returned to and inspected by the Company.

2. Basis of Hire

2.1
These Terms & Conditions apply to all hire agreements entered into by the Company.
2.2

The Hirer is deemed to have accepted these Terms:

  • Upon written or email confirmation,
  • Upon acceptance of a quotation, or
  • Upon dispatch of the Equipment.
2.3
These Terms override any terms provided by the Hirer unless expressly agreed in writing by the Company.
2.4
The Hirer acknowledges that it has not relied on any representation, advice or statement made by the Company other than as expressly set out in writing.

3. Ownership

3.1
All Equipment remains the property of the Company at all times.
3.2
The Hirer shall not sell, assign, charge, or otherwise dispose of the Equipment.

4. Hire Period

4.1

The Hire Period commences on delivery and continues until:

  • The Equipment is returned, and
  • The Equipment has been inspected and checked in by the Company.
4.2
A minimum hire period of 4 weeks applies.
4.3
The Hirer shall be charged for the full minimum hire period regardless of early return.
4.4
No refund or reduction in charges shall apply where Equipment is returned before the end of the minimum hire period.
4.5
Hire charges shall continue until the Equipment is physically returned and inspected by the Company.

5. Delivery & Collection

5.1
Delivery may be made via pallet network or third-party carrier.
5.2
Risk in the Equipment passes to the Hirer immediately upon delivery, whether or not a signature is obtained.
5.3

The Hirer is responsible for:

  • Safe unloading
  • Suitable access
  • Ensuring the correct receipt of Equipment

6. Use of Equipment

6.1

The Hirer shall:

  • Use the Equipment only for its intended purpose
  • Ensure it is used only by competent persons
  • Comply with all applicable legislation and safety requirements
6.2

The Equipment:

  • Is supplied as a visual deterrent only
  • Is not a vehicle restraint system or impact protection barrier
6.3
The Hirer accepts full responsibility for the manner in which the Equipment is installed, deployed, used, and monitored.
6.4
The Hirer confirms that all persons responsible for the installation, operation, and monitoring of the Equipment are competent and possess sufficient knowledge, training, and experience.

7. Risk Assessment & Deployment

7.1
The Hirer is solely responsible for carrying out a suitable and sufficient site-specific Risk Assessment and Method Statement (RAMS) prior to use.
7.2

This assessment must include, but is not limited to:

  • Wind loading and environmental conditions
  • Ground conditions
  • Traffic interaction and vehicle-induced air movement
  • Determination of appropriate ballast
  • Stability of the Equipment under foreseeable conditions
7.3

The Company:

  • Does not provide site-specific advice
  • Does not assess environmental conditions
  • Does not determine ballast requirements
7.4

The Hirer acknowledges that:

No wind loading calculations or ballast specifications are provided by the Company.
7.5

The Hirer accepts full responsibility for:

  • Stability of the Equipment
  • Suitability of deployment
  • Safety of use under all conditions

8. Ballast & Stability

8.1
The Hirer must ensure the Equipment is adequately ballasted at all times.
8.2
The Hirer is solely responsible for determining the type and quantity of ballast required.
8.3

The Equipment must not be used where there is any foreseeable risk of movement, including (but not limited to):

  • Wind exposure
  • Vehicle-induced air displacement
  • Unstable or unsuitable ground conditions
8.4
The Company accepts no responsibility for instability or movement of the Equipment.

9. Inflation (Where Applicable)

9.1
The Equipment must be inflated strictly in accordance with the instructions provided.
9.2

Maximum inflation pressure:

2.0 PSI (140 mbar)
9.3

The Hirer must not:

  • Overinflate the Equipment
  • Use booster settings for final inflation
9.4
The Hirer accepts full responsibility for ensuring correct inflation at all times.

10. Maintenance & Care

10.1

The Hirer shall:

  • Keep the Equipment in good condition
  • Not modify or alter the Equipment
  • Report faults immediately
10.2
The Hirer shall immediately cease use if the Equipment is damaged, unstable, or unsafe.

11. Loss, Damage & Responsibility

11.1
The Hirer is responsible for the Equipment from delivery until return and inspection.
11.2

The Hirer shall be liable for:

  • Loss
  • Theft
  • Damage
11.3
Responsibility includes all risks arising from use, misuse, or environmental conditions.

12. Beyond Economic Repair (BER)

12.1

Equipment shall be deemed beyond economic repair where:

  • Repair is not possible, or
  • Repair cost is deemed uneconomical by the Company
12.2
In such cases, the Hirer shall be charged the full replacement cost.

13. Inspection & Charges

13.1
All Equipment will be inspected upon return.
13.2

Charges may apply for:

  • Damage
  • Cleaning
  • Repairs
  • Replacement
13.3
The Company’s assessment of damage, repair or replacement shall be final and binding.

14. Limitation of Liability

14.1

To the fullest extent permitted by law, the Company shall not be liable for:

  • Any loss, damage, or injury arising from use of the Equipment
  • Failure of the Hirer to carry out adequate risk assessment
  • Instability, movement, or failure of the Equipment
  • Environmental or site conditions
14.2

The Hirer acknowledges that:

  • The Equipment is supplied without site-specific assessment
  • The Company does not guarantee stability under any conditions
14.3
Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence.

15. Indemnity

The Hirer shall fully indemnify and hold harmless the Company against all claims, losses, damages, costs, and liabilities arising from:

  • Use of the Equipment
  • Failure to carry out adequate RAMS
  • Improper deployment
  • Environmental conditions

16. Insurance

16.1

The Hirer shall maintain appropriate insurance for the duration of the Hire Period, including:

  • Cover for loss or damage to the Equipment
  • Public / third-party liability arising from use of the Equipment
16.2
The Hirer shall ensure that such insurance is sufficient to cover the full replacement value of the Equipment and any associated liabilities.
16.3
The Company accepts no liability for any uninsured loss.

17. Termination

The Company may terminate hire immediately if:

  • These Terms are breached
  • Equipment is misused
  • Payment is overdue

18. Payment

18.1
Hire charges apply as agreed.
18.2

Additional charges may apply for:

  • Damage
  • Loss
  • Extended hire

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.
